Terms of Use

1. Introduction

Welcome to Arceus ("Service"), a software product operated by Sait Burak Yücekaya ("we", "us", "our"), a sole proprietorship based in Turkey. By accessing or using Arceus, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Service.

2. Service Description

Arceus is a proxy service that enables developers to use local and cloud large language models (LLMs) with IDE coding tools such as Cursor, VSCode Copilot, and Claude Code. The Service provides an OpenAI-compatible API layer that bridges tool compatibility between IDEs and various model providers.

3. Merchant of Record

All payments for the Service are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. Paddle handles billing, sales tax, currency conversion, and payment processing on our behalf. By purchasing a subscription, you also agree to Paddle's Terms of Service and Privacy Policy.

4. Account Responsibilities

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials and API keys.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 18 years old to use the Service.
  • You must notify us immediately at support@arceus.app if you suspect unauthorized use of your account.

5. Subscription Plans

Arceus offers the following subscription tiers:

  • Free: Access to all models with a 1-hour daily usage limit. No payment required.
  • Pro: Unlimited usage, priority model routing, hybrid agent mode, and priority support. Billed monthly or annually through Paddle.

Pricing is subject to change. We will notify existing subscribers before any price changes take effect on their accounts.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal, harmful, or unauthorized purpose.
  • Attempt to reverse engineer, decompile, or disassemble the Service.
  • Interfere with or disrupt the Service or its infrastructure.
  • Share your API key with unauthorized third parties or exceed reasonable usage limits.
  • Use the Service to generate content that violates applicable laws or the terms of the underlying model providers.
  • Resell, sublicense, or redistribute access to the Service without our written consent.

7. Intellectual Property

All rights, title, and interest in the Service, including its software, design, and documentation, remain with us. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. Code and content generated through local models running on your hardware remain your property.

8. Third-Party Services

The Service integrates with third-party model providers (Anthropic, OpenAI, Google, etc.) and tools (Ollama, llama.cpp). Your use of these services is subject to their respective terms. We are not responsible for the availability, accuracy, or content generated by third-party models.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the event giving rise to the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. You may cancel your subscription at any time through your dashboard. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
